Fair Housing Rights for People with Mental Illnesses

May is Mental Health Awareness month. Here at KFHC we are taking part by raising awareness for the rights of people with mental illness and how the Fair Housing Act protects them.


Individuals with mental illnesses are protected under fair housing laws, which ensure they have equitable access to housing. Here are the key rights that individuals with mental health conditions should be aware of:

  • Protection from Discrimination: Individuals cannot be discriminated against in housing based on their mental health status or disability. This includes being denied housing or subjected to different terms and conditions because of their mental health history.

  • Right to Reasonable Accommodations: Tenants with mental health conditions can request reasonable accommodations to policies or practices to ensure they have equal access to housing. This might include adjustments in rules or additional support services.

  • Access to Housing Information: Individuals have the right to receive clear and accurate information about available housing options. Housing providers must disclose their policies and procedures transparently.

  • Use of References: When lacking a traditional rental history, individuals may use references from sober living homes or shelters to demonstrate their reliability as tenants.

  • Protection Against Retaliation: Tenants are protected from retaliation for asserting their rights under fair housing laws, such as filing a complaint or requesting accommodations.

  • Right to Privacy: Individuals have the right to keep their mental health status private and are not required to disclose it unless necessary for a reasonable accommodation.
